ProPublica Investigates Why Health Insurance Regulators Have Been Unsuccessful in Addressing Ghost Networks

Uncovering the Truth: The Epidemic of Ghost Networks in Health Insurance

In a groundbreaking investigation, ProPublica has uncovered widespread errors in health insurance provider directories across multiple states, leading to the creation of so-called “ghost networks.” These ghost networks are comprised of providers listed as in-network by insurance companies but are either unreachable, not in-network, or not accepting new patients when contacted by consumers.

The investigation, conducted by staffers with the New York state attorney general’s office, involved calling mental health providers listed in insurance directories to determine if they accepted insurance and were accepting new patients. The results were alarming, with 86% of providers being unreachable or not in-network. Despite these findings, state insurance regulators have failed to issue fines or hold insurers accountable for these errors.

Similar patterns of errors and lax enforcement were found in other states, including Arizona, Massachusetts, and California. Regulators in these states have conducted investigations into provider directories but have not taken significant action to address the issue of ghost networks.

Experts in the healthcare industry have emphasized the need for stricter regulations and stronger fines to protect consumers from these errors. Without proper enforcement, insurers will continue to sell plans with inaccurate provider directories, leading to significant barriers to accessing care.

The investigation also revealed that federal regulators have stepped in to monitor directory errors in states where enforcement is lacking. However, fines have not been issued, and insurers are expected to make “good-faith” attempts to comply with federal regulations.

In response to these findings, lawmakers in California proposed a bill to limit errors in provider directories and increase penalties for violations. The bill, AB 236, aims to establish one of the nation’s toughest ghost network regulations to protect consumers from inaccurate information.

Despite these efforts, challenges remain in enforcing regulations and holding insurers accountable for ghost networks. State lawmakers and advocates continue to push for stronger enforcement measures to ensure that patients have access to the healthcare they need.

The investigation by ProPublica sheds light on a critical issue in the healthcare industry and underscores the importance of addressing ghost networks to protect consumers and improve access to care.
